Terms of Service

Effective 12 September 2026 Version 1.0 Applies to the H2U Android app

1This agreement

These terms are the agreement between you and Naman Mehta, trading as Ten Night Labs ("we", "us", "our"), a sole proprietor established in Japan, for use of the H2U mobile application.

By creating an account you accept these terms. If you do not accept them, do not create an account — the app cannot be used without one.

Our Privacy Policy explains what we do with your data and forms part of this agreement. Where the two documents describe the same thing, they are written to agree; if they ever conflict, the Privacy Policy governs on data matters.

2Who can use H2U

You must be 16 or older. H2U is not directed at children and we do not knowingly permit accounts for anyone under 16.

We set 16 rather than a lower age deliberately. The app collects health information — your body metrics and hydration record — and several countries set the age of valid consent for that kind of data at 16. A single threshold meeting the strictest applicable rule is safer than one that varies by country.

If we learn that an account belongs to someone under 16, we will close it and delete the data with it.

You must also be capable of entering a binding contract where you live, and not barred from using the app under any applicable law.

3Your account

4What H2U is, and is not

H2U records what you drink, calculates a suggested daily intake from figures you provide, and — if you pair with someone — shows each of you the other's daily progress and lets you send short encouragements.

Not medical advice

Your recommended daily intake is general wellness guidance calculated from figures you enter and published population estimates. It is not medical advice. H2U is not a medical device, and it does not diagnose, treat, cure or prevent any condition.

Do not rely on it if you have a heart, kidney or liver condition, if you are pregnant, if you take medication affecting fluid balance, or if a clinician has given you a specific fluid target. Their advice governs, not ours. Drinking substantially more water than your body needs can be harmful.

If you have any doubt about the right amount of fluid for you, ask a qualified professional rather than an app.

We do not personalise the target on any health condition, and you must not use the app as though we did.

5Pairing, and what your partner sees

Pairing is optional and the app is fully usable alone. You pair by sharing an invite — a QR code, valid for 15 minutes, or a link, valid for 7 days.

When you pair, your partner can see:

Your partner cannot see your individual drinks, your body metrics, your wake and sleep times, your email address, or your subscription status.

Either of you can unpair at any time, without the other's agreement. Unpairing takes effect immediately and removes their access to your data, including the shared history. It also has consequences for subscriptions — see §11, which is the part people are most likely to be caught out by.

You can also block another user. Blocking stops all contact from them immediately and is not disclosed to them.

6Nudges and acceptable use

A nudge is a message of up to 140 characters sent to your partner as a notification. Nudges are rate-limited, and are not delivered outside the hours you have told the app you are awake.

When you send a nudge you are sending a message to a real person. You must not use nudges, your display name, or any other text you enter to:

You must also not attempt to break, overload or circumvent the app or its servers — including circumventing rate limits, the paywall, or the once-per-person rules in §7 and §8.

We may suspend or close an account that breaches this section. §16 explains how.

Between the two of you

An app that lets one person prompt another about their habits can be used to nag rather than encourage. The rate limits and quiet hours exist to make that harder. If someone is using nudges to pressure you, block them — it takes effect immediately and they are not told.

7The free trial

New accounts receive a 7-day free trial of premium features, granted automatically at signup. No payment details are required and it does not convert into a paid subscription — when it ends, the app continues with free features until you choose to subscribe.

The trial is once per person, permanently. It is tied to your email address, not to your account, and the record of it survives account deletion. Deleting your account and registering again with the same address will not produce a second trial.

We keep an irreversible one-way hash of the address for this purpose — never the address itself. §10 of the Privacy Policy explains exactly what is stored and why.

8The pairing reward

When you pair with a partner, both of you receive 30 days of premium, granted automatically once the pairing completes.

Like the trial, it is once per person, permanently, enforced by the same irreversible hash and surviving account deletion. Pairing, unpairing and re-pairing — with the same person or a different one — does not produce a second reward.

9Coupons

We sometimes issue coupon codes granting a period of free premium. Coupons may carry an expiry date and a limit on total redemptions, may be withdrawn at any time before redemption, have no cash value, and cannot be exchanged, sold or transferred.

A coupon that has expired or reached its redemption limit will be declined. We are not obliged to replace it.

10Subscriptions

Premium features are available by subscription in 3-month, 6-month and 12-month terms. Prices are shown in the app before you buy, in your local currency, and may change — a change never affects a term you have already paid for.

11The couple licence

H2U is built for two people, so a single subscription covers both.

While you are paired, one partner's subscription gives premium features to both of you. Only one of you needs to pay. If you both subscribe, both subscriptions remain your own and neither is refunded or merged.

Read this before relying on shared premium

If you unpair, the partner who is not paying loses premium immediately.

Not at the end of a billing period, and not after a grace period. The moment the pairing ends, shared access ends with it.

Either of you can unpair at any time, without the other's agreement. So if you are the partner receiving shared access, your premium depends on a decision the other person can make alone, at any moment, with no notice to you.

The paying partner is unaffected and keeps the subscription they bought.

Shared access also ends if the paying partner's subscription lapses, is cancelled, or is refunded. In every case the shared access follows the paying subscription; it is never independent of it.

Shared access is not a purchase. The receiving partner has bought nothing, so there is nothing to refund when it ends. If you want premium that does not depend on someone else's pairing decision, buy your own subscription.

Any free time you hold in your own right — a trial under §7, a pairing reward under §8, or a coupon under §9 — is unaffected by unpairing. Those are yours and they run their course.

12Cancelling and refunds

Cancelling

Cancel through Google Play — Play Store, then Payments and subscriptions. That is the only place a subscription can be cancelled; we cannot do it for you.

Cancelling stops the next renewal. You keep premium until the end of the term you have already paid for.

Deleting your account does not cancel your subscription

These are two separate systems. Deleting your H2U account removes your data from our service, but your subscription lives with Google Play and continues billing until you cancel it there. Cancel first, then delete.

Refunds

Because Google Play processes every payment, refunds are handled by Google under its refund policy, together with any statutory right you have where you live. We cannot refund a payment we never received.

Request a refund through Google Play. If you believe something has gone wrong on our side, contact us — we cannot issue the refund, but we can look into the underlying problem.

13Content and intellectual property

Yours stays yours. Your hydration records, body metrics and nudge text belong to you. You grant us only the permission needed to run the service: to store your data, show it to you, deliver your nudges to the partner you addressed them to, and show a paired partner the limited information §5 lists. Nothing more. We do not use your content to train anything, to advertise, or to sell.

Ours stays ours. The app, its name, its design and its code are ours or our licensors'. You may use the app as intended; you may not copy, resell, reverse-engineer or redistribute it, except where the law says you may regardless of what we write here.

You are responsible for the content you send. Do not send anything you have no right to send.

14Availability

We aim to keep H2U working and available, but we do not promise it will be uninterrupted or error-free. It depends on services we do not control — Google Play, Firebase, our hosting provider, and your device and network.

We may change, suspend or withdraw features. Where a change materially reduces what a paid subscription provides, §18 applies and you may cancel.

Notifications are not guaranteed. Delivery depends on Google's messaging service, your device's power settings and your notification permissions. Do not rely on a nudge or a reminder arriving at a particular time, or at all.

15Our liability

Nothing in these terms excludes or limits our liability where the law does not permit it. Under Japanese law, in particular, a term that wholly excludes a business's liability to a consumer has no effect, and we do not attempt one.

We remain fully liable for loss caused by our intentional misconduct or gross negligence, and for death or personal injury caused by our negligence.

Otherwise, and to the extent the law allows:

If you are a consumer, you keep every right the law of your country gives you. These terms do not take those away.

16Suspension and termination

By you

Delete your account at any time, from Settings or from our deletion page. No reason needed and no notice required. Cancel any subscription in Google Play first — see §12.

By us

We may suspend or close an account that breaches these terms, particularly §6. Where it is reasonable to do so we will warn you first and explain what needs to change. Where the breach is serious — harassment, or a threat to another user's safety — we may act immediately.

If we close your paid account for a breach you did not commit, we will help you obtain a refund from Google for the unused period. If we close it for a breach you did commit, we are not obliged to.

You can contest a suspension by contacting us, and we will review it and reply.

17What survives deletion

Deleting your account removes your profile, body metrics, drink history, routine, pairings, nudges and notification tokens. Two things do not go, and both are irreversible one-way hashes of your email address that can never be turned back into it:

18Changes to these terms

We may change these terms when the app changes or the law requires it.

Continuing to use the app after a material change takes effect means you accept it.

19Governing law and disputes

These terms are governed by the laws of Japan.

If we cannot resolve a dispute between us, it goes to the courts of Japan. We have deliberately not required arbitration: consumer arbitration clauses are restricted or void in several countries, and we would rather have terms that hold everywhere than ones that quietly fail where you live.

If you are a consumer, this does not deprive you of the protection of your own country's mandatory consumer law, or of the right to bring proceedings in your local courts where that law gives it to you.

Please contact us before starting anything formal. Most disputes are misunderstandings and are quicker to fix directly.

If any part of these terms is unenforceable, the rest continues to apply. If we do not enforce a term immediately, we have not given it up.
